Remember the Federal Constitution gives to the states those powers not explicitly spelled out in the Federal Constitution which means we have a lot more items to cover in our Constitution that the Federal Government does. They tried to simplify it about 30 years ago and after millions of hours spent over 6 months the citizens soundly defeated the effort since it eliminated items they wanted in the document. It is one of the toughest issues we have to deal with since federal preemption exists in many areas. Protecting our national borders is clearly a Federal Government Responsibility. But I am taking the lead in looking at the impact on our criminal justice system of illegal immigration. We have met with Federal Agencies and officials this year, we have held hearings on what the state can do in this area, we have looked at what is being done by law enforcement in our counties, and we do have a consistent policy for handling illegal immigrants in our criminal justice facilitie in Texas. I look forward to hearing from many of you on this issue in our focus groups.
